These Terms govern use of Retinue, a Shopify app operated by The BlueWhale.

1. Acceptance

By installing or using Retinue, you agree to these Terms on behalf of yourself or the business you represent. If you do not agree, do not install or use Retinue.

2. The service

Retinue helps Shopify merchants analyze repeat buyers across product drops, manage retention tiers, create perks, and support related lifecycle workflows. Features may change as the product evolves.

3. Merchant responsibilities

You are responsible for your Shopify store, your customer relationships, your marketing messages, your compliance obligations, and ensuring that you have the right to process data through Retinue.

4. Fees and billing

Paid Retinue plans are billed through Shopify or another disclosed billing provider. Fees, plan limits, trials, and renewal terms will be shown before purchase or approval.

5. Acceptable use

You may not misuse Retinue, attempt unauthorized access, reverse engineer the service, interfere with other merchants, or use the app for unlawful, misleading, or abusive activity.

6. Data and privacy

Our processing of personal data is described in the Retinue Privacy Policy. Merchants remain responsible for their own notices, consents, and lawful basis for processing customer data.

7. Third-party services

Retinue works with Shopify and may integrate with other merchant-selected services. Third-party services are governed by their own terms and policies.

8. Intellectual property

The BlueWhale retains all rights in Retinue. You retain rights in your store data. You grant us the limited rights needed to provide, secure, maintain, and improve the service.

9. Disclaimers

Retinue is provided on an "as is" and "as available" basis. We do not guarantee specific revenue, retention, or business outcomes.

10. Limitation of liability

To the fullest extent allowed by law, The BlueWhale will not be liable for indirect, incidental, special, consequential, or punitive damages. Any aggregate liability is limited to the fees paid for Retinue in the 12 months before the claim.

11. Termination

You may stop using Retinue by uninstalling the app. We may suspend or terminate access for breach, security risk, non-payment, or legal reasons. Data handling after uninstall follows the Privacy Policy and Shopify app requirements.

12. Governing law and contact

These Terms are intended to be governed by the laws applicable to The BlueWhale unless a final legal review specifies otherwise. Questions may be sent to admin@thebluewhale.online.
